A Guide to Civil Litigation Procedure in India
Every civil case begins with the filing of a plaint, which is essentially the foundation of the entire dispute. In this document, the plaintiff clearly lays out the facts of the case, the harm suffered, and the specific relief they are seeking—whether it is compensation, enforcement of a right, or an injunction to stop someone’s actions. The plaint must be precise because even small gaps or inconsistencies can weaken the case later. Once the court is satisfied that the plaint is in proper form and falls within its jurisdiction, it formally registers the case

After receiving the summons, the defendant files a written statement, which is their official reply to the plaintiff’s allegations. Here, they may admit, deny, or contest each claim, and can also raise defenses or counterclaims. This stage transforms the dispute from a one-sided complaint into a structured legal dialogue. The court then carefully studies both the plaint and the written statement to identify the real points of disagreement.

The evidence stage is often the longest and most detailed part of the litigation process. At this point, both parties are required to prove their claims and defenses with credible material. This includes documentary evidence like agreements, receipts, emails, or bank records, as well as oral evidence through witnesses. Each witness is first examined by the party who presents them, and then cross-examined by the opposing side to test their credibility and consistency. This back-and-forth questioning can be intense, as lawyers attempt to expose contradictions or weaknesses in testimony.
